Mailbox Repair Service LLC (“MRS,” “we,” “us,” “our”)
Effective Date: {{05/04/2025}}

USPS Notice. We are independent and not endorsed by or affiliated with the United States Postal Service (USPS).

1) Overview

We operate the following websites (collectively, the “Site”): mailboxrepairservice.com, mailboxrepairokc.com, and mailboxrepairtulsa.com.
We provide mailbox installation and repair services and related customer support (the “Services”). We may perform work directly or through qualified subcontractors we supervise.
By using the Site or booking Services, you agree to these Terms.

2) Eligibility; E-Sign; TCPA & Call Recording

You confirm you’re of legal age and authorized to contract. You agree to do business electronically (email, SMS/text, e-signature).
Calls & Texts. By providing a number, you consent to calls/texts (including autodialed/prerecorded) about quotes, scheduling, updates, and reviews. Msg/data rates may apply. Opt-out: reply STOP (HELP for help). Transactional/legal notices may still be sent.
Call Recording. We may record customer calls for quality/training. If you do not consent, notify us and end the call.

3) Changes to Terms

We may update these Terms; the “Effective Date” will reflect the latest version. Continued use = acceptance.

4) Scope of Work; Changes; Hidden Conditions

Work is limited to the written estimate/invoice (“Scope”). Changes (materials, layout, hidden conditions, unusual concrete depth, unmarked utilities, unstable footings) may require written change orders and price/time adjustments.

5) Estimates, Scheduling & Access

Estimates are valid for 15 days unless stated. Start dates are estimates and may shift due to weather, material lead times, or prior jobs. You must provide clear/safe access to the site; pets secured; parking available.

6) Permits, HOA & USPS Placement

Unless our Scope states otherwise, you are responsible for permits/HOA approvals and final USPS placement compliance (height, setback, approach). We follow industry standards and advise typical USPS guidance, but final approval is yours.

7) Payments, Deposits, Late Fees & Chargebacks

Invoices are due upon receipt unless noted. We accept card/ACH/cash/check payable to Mailbox Repair Service LLC.
Projects >$600 may require a 30–50% deposit to reserve materials/labor (credited to the final bill). Special-order items are non-cancelable once ordered.
Past-due balances may accrue 1.5%/mo (or max allowed) plus reasonable collection/attorney costs. We may file a mechanics lien where permitted.
Chargebacks. You agree not to file a chargeback without first giving 10 business days’ written notice to resolve.

8) Title & Risk

Title to materials passes upon full payment. Risk of loss transfers at substantial completion or delivery to site (whichever first).

9) Privacy & Accessibility (Incorporated)

Your use of the Site is governed by our Privacy Policy and Accessibility Statement, which are incorporated by reference.

10) Photos, Media & Reviews

You grant us a non-exclusive, royalty-free license to use non-identifying project photos/videos for documentation and marketing. You can revoke permission by emailing support@mailboxrepairservice.com.

11) Acceptable Use (Site)

No unlawful, fraudulent, harassing, or disruptive use; no malware; no scraping contrary to robots.txt; no reproduction of content without consent.

12) Third-Party Tools & Links

Third-party maps, forms, payments, and widgets are provided “as is” under those parties’ terms/policies. We’re not responsible for them.

13) Warranty (1-Year Workmanship) & Materials

Labor. We warrant our workmanship for 1 year from substantial completion. Our sole obligation is to repair or re-perform the covered work.
Materials. Manufacturer warranties pass through to you. Brick/stone/finish matching is “close match” only—aging, dye lots, patina, and texture variations are normal.
Exclusions. Impact/accident (vehicles, mowers), vandalism/theft; weather/acts of God (freeze-thaw, hail, wind, floods, lightning); soil/ground movement (settlement, erosion, tree roots); sprinkler overspray/water intrusion; third-party alterations; code/USPS changes after install; cosmetic-only issues (hairline cracks, efflorescence, patina) that don’t affect function/safety; unpaid accounts.
Voids. Warranty is void if (a) balance unpaid; (b) others alter/repair before we inspect; or (c) access for inspection/repair is denied.
How to claim. Email support@mailboxrepairservice.com within 30 days of discovery (and within 1 year of completion) with photos, address, and invoice #. We’ll schedule inspection and, if covered, repair within a commercially reasonable time.

14) Property Conditions, Utilities & Limits

You must identify/mark utilities and underground hazards (call 811). We are not liable for unmarked or inaccurately marked utilities/irrigation/low-voltage lines. Reasonable landscape disturbance may occur; standard cleanup is included, but landscape/irrigation restoration is not unless quoted.

15) Cancellations, Reschedules & Trip Fees

Customer-initiated <48 business hours: $50 mobilization fee + any non-returnable/special-order materials.
No-access on arrival / unsafe site: $50 trip fee (plus re-schedule).
If work cannot proceed for reasons outside our control (permits/HOA, USPS placement, third-party delays), we’ll reschedule; refunds are not offered for time/materials already incurred.

16) Subcontractors

We may engage qualified subcontractors and remain responsible for supervising their work within the Scope.

17) Accuracy; Illustrative Media

Site info is general and may change without notice. Photos/testimonials may include stock or customer-submitted images for illustration.

18) Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY SET OUT HERE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS. Nothing in these Terms limits any non-waivable consumer rights.

19) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE, SERVICES, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC WORK GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE.

20) Taxes & Government Fees

You’re responsible for applicable taxes, fees, and assessments.

21) Governing Law; Disputes; Arbitration; Class Waiver

Oklahoma law governs (conflict rules excluded).
Informal resolution. The parties will try to resolve disputes in good faith within 30 days after written notice.
Binding arbitration (consumer). If not resolved, disputes are resolved by AAA Consumer Arbitration Rules. Venue/seat: Tulsa County, Oklahoma (video hearings permitted). Either party may bring an individual claim in small-claims court.
Class waiver. Claims may be brought only in an individual capacity—no class/collective/representative actions.
Equitable relief. Either party may seek injunctive relief for IP/confidentiality violations.

22) Force Majeure

Neither party is liable for delays/failures beyond reasonable control (storms, disasters, strikes, war, supply-chain failures, government actions).

23) Assignment

You may not assign these Terms without our written consent. We may assign in connection with a reorganization, merger, acquisition, or sale.

24) Severability; No Waiver; Interpretation; Survival

If any provision is unenforceable, it will be modified to the minimum extent necessary; the rest remains in effect. Headings are for convenience only. Sections that by nature should survive (including §§10–21) survive termination.

25) Entire Agreement; Conflicts

These Terms, plus the incorporated Privacy Policy and Accessibility Statement, are the entire agreement for Site/Services and supersede prior communications. If these Terms conflict with a signed, project-specific agreement, the project agreement controls.
